By using this website and its services you agree to abide by the terms set out as following:

Payment terms

In order to secure your course you must pay The Training Circle (UK) Ltd the appropriate costs in full or in part, with the remainder due before the course start date.

Course participants (or ‘Participant’) may also reserve a place on the course via the appropriate course booking page on this website and pay a premium price on the day of training course. Please note however that a booking without payment is not  guaranteed. Participants will be allowed to join the training depending on the size of the available class room on the day. If the class room is full participants maybe asked to attend the following course.

Where a training course is offered at a discount from our list price, the discounted price offered is subject to payment with booking and availability of places.

Payment can be made by Visa, Mastercard, cheque or bank transfer. Cheques are payable to The Training Circle (UK) Ltd. Bank transfer details are available on request.

The Training Circle (UK) Ltd reserves the right to change prices without notice.

Refunds policy

If a course participant is unable to attend on the reserved scheduled course date, they should notify The Training Circle (UK) Ltd atleast 4 weeks ( including weekends ) in order to secure a 100% refund.

If a course participant fails to notify us by phone in advance of the inability to attend on the course date reserved, then a re-booking will have to be made, provided that the candidate has contacted us within 4 weeks of the original course date reserved.

If the participant fails to contact us within 4 weeks of the original course date reserved, then any re-booking after that date will treated as a new booking and will attract the full course fee in force at that time.

The Training Circle (UK) Ltd operates the following refund policy in respect of the cancellation of individual course bookings.

If a candidate cancels his course 4 weeks before start date ( including weekends )  100%  will be refunded.

If a fully paying candidate cancels his course 3 weeks before start date ( including weekends ) a £48 admin charge will be incurred and remaining refunded

If a fully paying candidate cancels his course  2 weeks before start date( including weekends) a £60 admin charge will be incurred and remaining refunded

If a fully paying candidate cancels his course 1 week before start date ( including weekends) a 50% admin charge will be incurred and remaining refunded.

If a fully paying candidate cancels his course 3 days ( 72 hours ) before start date The Training Circle (UK) will refund £25 ONLY.

If a deposit paying candidate cancels his course 3 weeks before start date , 100% will be refunded

If a deposit paying candidate cancels his course 10 days before the course start date 56% will be refunded.

If a deposit paying candidate cancels his course 3 days before the course start date 33% will be refunded.

If a deposit paying candidate FAILS to attend the course , The Training Circle UK will not refund the deposit.

Please note: Refunds take 7 working days to process and may be subject to delays from Paypal and your credit / debit card issuer.

If a course is run exclusively for a corporate customer at The Training Circle (UK) Ltd training centers or on a customer site or any other alternative venue,  the same 85% refund terms apply in the event of cancellation, but an alternative course date can be arranged by agreement.

Rescheduling Policy

If the candidates wishes to reschedule the course 10 days prior to the start date, The Training Circle will not charge any extra fee.

If the candidates wishes to reschedule the course within 10 days of the course start date, The Training Circle will charge a £10 admin fee.

If the candidate wishes to reschedule the course 3 days prior to the course start date, The Training Circle will charge a £20 administration fee.

If we change your course

In the unlikely event it becomes necessary to change your course, in total or in part, The Training Circle (UK) Ltd will inform you as soon as is reasonably possible of any necessary changes. You shall have the choice of:

accepting the changed arrangements;

or purchasing another course from The Training Circle (UK) Ltd (and paying or receiving a refund in respect of any differences);

or cancelling your course and receiving a full refund of all payments made.

Delay or failure to perform on our part

We shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation):

an act of God, explosion, flood, fire or accident;

war or civil disturbance;

strike, industrial action or stoppages of work;

any form of government intervention;

a third party act or omission;

failure by you to give us a correct delivery address or notify us of any change of address.

Our promise to you

The Training Circle (UK) Ltd shall ensure that all services you order from us are in accordance with these terms and conditions and shall be performed by us with all reasonable skill, care and utmost professionalism.

Where an element of your course is not provided as stated in the course instructions you must notify us within 28 days of the alleged breach. We shall then investigate the matter and if we have not delivered the services in accordance with the course content, objectives and guidelines you shall be entitled to:

a full refund of the cost of your course (or, where appropriate, the relevant section of it) less any fees charged for changes requested by you;

or a free course to the equivalent value of the services complained of, where such dates are agreed in writing by us.

We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for:

any losses which are not foreseeable by both you and us when the Contract is formed arising in connection with the supply of the services or their use by you;

any losses which are not caused by any breach by us; business or trade losses.

Our entire liability in connection with training services will not exceed the purchase price of the services booked less any amendment charges paid to us.

Except in relation to death or personal injury caused by our negligence The Training Circle (UK) Ltd's liability remains, at all times, limited to the value of the services booked, excluding any amendment charges paid to us.

Whilst we always  try and perform the training ourselves we in certain circumstances have the right to use alternate training providers.

Behaviour

If your behaviour is deemed to be unacceptable or causes damage your course may be terminated and you may be asked to leave the premises. Your application form and contact details will be retained pending further enquiry.

No whole or part refunds will be made under these circumstances.

Complaints Procedure

If you have any concerns or feedback about the quality of our course and wish to raise a formal complaint please email us on quality@thetrainingcircle.co.uk. We will investigate the complaint and contact you by phone, email or post to notify you of the outcome within 20 working days. 

You may however also raise your complaint directly with the awarding body i.e. HABC or the regulator i.e SQA. 

If you wish to appeal against the outcome please inform us within 10 working days. After such period the decision will be deemed acceptable. Similarly, you can also appeal against the decision directly to the awarding body or the regulator.

Results

Exam papers are marked by an external awarding body, and results are made available in 10 working days of sitting the exam, there may be a further delay in exam results by the awarding body.

The Training Circle (UK) Ltd will not be liable for any kind of loss in case of a delay in result.

Examination re-sit

In the unlikely event of failing the exam or any part of the exam, participants will be allowed to take the exam at a £25 resit examination cost.

Learners must contact The Training Circle (UK) Ltd on 0800 567 7639 to arrange re-sit date, candidates cannot be allowed to appear on the exam day withour prior arrangement.

The Training Circle (UK) Ltd will offer the best available date and location for re-sits.

Your information

We shall only store and use the information you supply to us or which is supplied to us for the purposes of carrying out our contact with you and to inform you of other services and offers which we make available from time to time.

Governing Law and Jurisdiction

The contract is subject to English law and the exclusive jurisdiction of the English Courts.

The Training Circle (UK) Ltd does not represent or warrant that the information on this website will be accurate, reliable, complete or current. The Training Circle (UK) Ltd advises you to verify the accuracy of any information on the website before relying on it.

All warranties, representations, conditions and guarantees, whether express of implied by statute, common law or otherwise relating to information on this website are excluded to the maximum extent permitted by law.
